2 men face capital murder charges in shooting death of unborn baby, Dallas police say

Two men face capital murder charges for allegedly shooting at a vehicle, hitting a pregnant woman and killing her unborn baby early Sunday morning.

Dallas police officers responded to a call for backup about 12:40 a.m. from a separate unit who was flagged down in the 4700 block of Wimbelton Way by alleged shooting victims, according to an arrest warrant affidavit. 

Officers found a red GMC Acadia at the scene with an unidentified man, woman and child inside. The child told police that the man, her brother, entered the 7-Eleven at 4710 S. Buckner Boulevard just before 12:30 a.m. 

Her brother was approached by an unidentified man about a minute later as he exited the 7-Eleven and a “verbal altercation” occurred, the affidavit said. 

The man pushed her brother before he got back into the Acadia, rolled down the window and told him and the other man in the vehicle to “watch out,” the child told police.

The child said as the Acadia left the parking lot, she saw a green laser coming from the other mens’ silver Chevrolet SUV, then saw one point a gun at them and fire, the affidavit said. 

Police said the child’s brother recounted a similar story. 

The woman told officers she was 22 weeks pregnant, the affidavit said. She was shot twice in the thigh and once through the pelvis, according to the affidavit. 

Dallas Fire-Rescue took the woman to the hospital, where she underwent an emergency cesarean section. Due to extensive injuries and being born four months premature, the baby died, according to the affidavit.

The man and the child were not injured, according to the affidavit. The Acadia sustained a broken passenger window and rear windshield. 

Officers found numerous shell casings and broken glass at the 7-Eleven and along Buckner Boulevard, according to the affidavit. Police also confiscated cocaine and methamphetamine from the suspected gunmens’ SUV.  

Officers identified the suspects by watching surveillance footage and speaking to another man whose car was hit on Buckner Boulevard in the crossfire, the affidavit said.

The two men were arrested about 6:45 a.m. after two attempted traffic stops where they fled from police. 

Police said the two men, a 17-year-old and a 20-year-old, initially faced aggravated assault with a deadly weapon, narcotics and gun charges. After the death of the baby, police said they now also face capital murder charges.
